London: A temporary cap on the number of skilled workers from India and other countries outside the European Union was introduced in June 'unlawfully', the High Court ruled on Friday.
Home Secretary Theresa May had introduced the cap as an interim measure before a permanent cap to be in place from April 2011. It was challenged on the ground that ministers had 'sidestepped' parliamentary scrutiny before announcing the
temporary cap.
The legal challenge to the cap of 24,100 until April 2011 was brought by the Joint Council for the Welfare of Immigrants (JCWI) and English Community Care Association, and was upheld by judges on Friday.
The Home Office said this did not imperil its flagship immigration policy but the opposition Labour said the police it was in "chaos" after the court ruling.
The ruling has nullified the current temporary cap, meaning it is no longer in force.
The cap was one of the first measures of the coalition government that promised to bring down immigrations from hundreds of thousands every year to 'tens of thousands.
In today's ruling, Lord Justice Sullivan and Justice Burton concluded that the home secretary had not gone through the proper parliamentary procedures before implementing the cap, which took effect without a vote in Parliament.
The judges said: "The secretary of state made no secret of her intentions. There can be no doubt that she was attempting to side-step provisions for Parliamentary scrutiny set up under provisions of the 1971 Immigration Act and her attempt was for that reason unlawful." As a result, it said no lawful limits were now in place for Tier One and Tier Two applicants from abroad. The Home Office said it was still "firmly committed" to reducing levels of net migration. "I am disappointed with today's verdict," Immigration minister Damian Green said, adding: "We will do all in our power to continue to prevent a rush of applications before our more permanent measures are in place".

Hello,
My Present H1B stamp is with company A and expires November 20 2007. Now I'm with company B and with this I have my petetion (H1B approval) which expires June 20 2008. Now I'm travelling to India for my marriage and coming back September 8. I'm not getting the new stamp this time. Will I have any problem during the immigration ??
Also with my present papers, my wife would be attending her visa Interview on Sep 4. Will there be any problem for her at the interview ???

If you are a IV member living in NY and want to be actively engaged in the NY chapter activities, please send a PM to bottlemani. If all those in NY get together, it will be easier to plan joint visits to congress people: house members and senators. Even if you don't have a car, we will be able to coordinate better if we know you are willing to spare some time.
I am sure there are many members in NY. It is a big state with several businesses.

--This should not be a problem, since the H1-B is a dual-intent visa
2. Is H1-B extension based on I-140 possible when not in US?
--Yes. Moreover, if you are in India for a year or more, your 6-year clock starts again.

Hello,
I do not think Swift 3D has a wireframe export features, but you can press the Print Screen button and paste the image into an image editor. You will be able to manipulate it like you would any other image. That is the best way that I know of doing it. You could also import the Swift 3D swf into Flash, and let Flash export the movie as a sequence of images.

Here is an excerpt from the link below.. it sounds crazy
"Visa numbers can retrogress in the middle of a month and become unavailable without prior notice. If there is a mid-month retrogression, USCIS could elect to stop accepting adjustment applications. While this is unlikely to occur in July 2007, it becomes more and more possible as the fiscal year progresses. "
I hope this doesnt happen.

Hi,
My PERM got denied next day after filing 7th year H1B extension, Is my H1 will approve?
extension filied on Premium processing. what are the chance me to continue on H1 and green card process.

In case my H1B is revoked, do I still have the option of filing from a different company as I still have more than year left on my original visa? or can I still do a transfer?

I've received my EAD+AP and I 485 (filed, priority date Nov 05) through my husband's GC process. I currently work on H1B (3 yrs remaining on my H1B). One week ago got laid off and working with same company till end of month. While looking for new job I'm unable to decided whether to maintain my H1-B status or switch to EAD.
1) If I switch to EAD and husband has problems in I485 approval, can I switch back to H1B for remaining time or do I fall under H1 cap and start from beginning.
2) Should I transfer to H4 before leaving job and then look for new job with EAD to save remainder of time on H1B which I can use if something goes wrong with EAD.
3) Would it be safer to get H1B transfer to new employer and forget EAD till husbands I-485 gets approved.
4) If I get a job on EAD, do I've to file something with INS to let them know that Im not working on H1B. If getting back on H1B from EAD, do I file regular H1B application through employer or process is different if you get back from EAD to H1.

I am on my 2nd phase of H1B visa which is valid until 2012.
I want to quit my job and go back to my home country.
How long after I quit my job do I get to stay here to wrap up and ship my stuff??
Does that jeopardize my status? I plan to be here for about 30 days after quitting my job. WOuld that be ok? or is it overstaying?
If I ever need to apply for a tourist visa in future will this jeopardize my chances of getting a visa then?

Hello Friends,
My wife is on F1, doing her masters and is done with her course work, just left with one project (2 credits). Her college has the option of getting CPT (curriculum practical training) signed till the time her masters is not complete and then she is allowed to work off campus for 40 hours (full time).
I have also filled for my 485 application, so I was wondering what is her status now after filling for 485 . Also is it fine if she gets her CPT signed now after filing I485. I just want to be sure that getting her CPT signed has no negative impact on our I 485.
Any suggestions or anyone in similar situation

Hi,
I am working for "Company A" on L1B from Nov 2006. In 2008 April "Company B" filed H1B and it got approved and received approval letter with I-94 effective from Oct 1st 2008.
After getting H1B I did not move to Company B and continued work with "Company A" on L1B Visa. To void the I-94 received with my H1B Approval I traveled my Home country on Sep 28th 2008 and returned to US on Oct 6th 2008 on L1B visa and continuing my Job with "Company A"
My H1B Employer (Company B) did not revoke my H1B since I have not started working for him.
Now Company B is going to renew my L1B visa for another 2 years.
If they renewed my L1B Visa, what will happen to my H1B?
In future if I want to switch to H1B, can i switch to H1B with my current H1B or do I need to file new H1B with fresh quota (Which opens in April)?
