Dear All,
Need your help to let me know what are the options available after the denial of L1B petition?
A brief history of my petition which has been denied.
Case Applied: August 2008
RFE Issued against my case: April 2009
Response to RFE Submitted: May 2009
Case Denied : August 2009
Reason:Proposed job does not requires specialized knowledge and that you, as employee, do not possess specialized knowledge.
Other information: This case was a premium processing and still it took one year to make a decision. I am not sure why was that?
Can I reapply L1B blanket now (September, 2009)?
Also my job role is core developer in the project for 3.5 years now and I also support product related issues in a very complex financial project. I assume that my role was not correctly portrayed in the petition hence it got denied.
So, I need your help to let me know

They are increasing the fees only for the other apllications. I-485 and the related ones will maintain the same fees until August 17th. I think it says so on the announcement from USCIs.
All other forms except i-485 the fee increase will be effective from july 30th and i-485 will get increased post August 17th:)

i am on h4 and this was the first time a company filed for my h1b. so would that be ok if company "B" files for my h1b with h1b filed with company "A" is pending with RFE.

Has anyone in Charlotte, NC got a extension on the Driver's license on the basis on the H1-B renewal application receipt.
My spouse's driver's license expires this month end. I have applied for h1-b/h4 renewal, yet to receive the application receipt.But wanted to know if anyone here in Charlotte,NC got a extension/grace (30days or 90days) on the basis of the receipt.

Probably the last action rule triggers in your case from Oct'08 and you will not be considered in L-1 status anymore. You should talk to an attorney I guess.

so for employment based Gc, folks whose priority date is may 15, 2007 or later are in trouble OR folks whose I-140 is not filed before may 15, 2007 are in trouble ? Also what happens to someone who changes job, filed GC again has priority date/I-140 of a date earlier to may 15,2007

I have a approved H1b from company A. Company A also shared a copy of approval. I was never counted under H1b cap before this approval. If I now decide not to join company A and assuming company A will not cancel H1b, can I use this H1b to join another company B later using H1b transfer�???? I am presently on cap except H1b and need a cap subject H1b in order to move to any private firm. So approval from company A matters a lot to me.

You probably still have enough time if you go for PRemium Processing. LCA will take around a week and Premium H1 will take another 2 weeks .

Yes you can apply for an extension on medical grounds, be sure to include a letter from her Doctor and all the hospital records and explian clearly why the extension is required, this should get approved.

Yes for H1B you are entitled to get Return ticket back to your home country if you are being laid off or fired. Last year my earlier employer offer me return ticket to home contry. They specified that we are offering as per the clause or law of H1B visa. Offcourse I didnt accept it but you cant get money for not accepting this return ticket offer.

She definitely would have issues if plan to travel in TN visa. TN visa is not supposed to have any immigration intent.
The best thing to do is change her status to parolee and start working using EAD. There is no reason for her to continue in TN status, after filing 485.
